Terms and Conditions of Service

Our Terms and Conditions (T&Cs) are in place to ensure that all parties involved in the moving process know what their responsibilities are so the move goes as smoothly as planned and that no misunderstandings may occur during the move.

The T&Cs are also in place to ensure that the provided information is accurate so that the correct dates/times, size truck/vehicle, number of movers and the tools required to be able to conduct the move requested satisfactorily, as agreed.

Please note that BESTIN MOVING Interstate Removals And Backloading Services Australia is not a common carrier and can/will contract work out to its reliable and trusted network of Removals carriers.

In Brief/Summary

a) Contact Details and amendments: It is the customer’s duty to check and confirm that all details provided during the quote and booking stage are correct to the best of their knowledge. Any changes can only be made in writing by email from the person making the quote/booking. Additional costs may be incurred if inaccurate information is provided or if you are not contactable by phone.

b) Insurance: Transit Insurance ONLY Covers items in transit for fire, theft & rollover of truck. There is no insurance for accidental breakage, loss or property damage for and during your move unless otherwise advised or stated in the Quote/Contract. It is recommended all customers take out removals insurance on their move with an insurance provider of their choice. c) Pick Up: You will be contacted by telephone before pick up the day prior to the move however in some cases the morning of the pickup. There is no guarantee of specific times and dates due to unforeseen circumstances.

d) Delivery: A call will be made to you a day before delivery (if possible) advising of an approximate timeframe. With the Back loading service we do not guarantee delivery dates or times. Failure of the customer being available for and during delivery may incur additional costs for time, storage and/or re-delivery.

e) Packing: All items that are required to, are to/must be wrapped, packed, boxed(named) by the customer and ready for transportation

f) Blankets & covers: Removalists carefully wrap, cover and separate the main items with moving blankets

Work not included in consultation

Unless agreed in writing with the client and Bestin Moving and/or the Removals Contractor, they will not, as part of the quoted removal services:
– Disconnect or reconnect appliances, fixtures, fittings or equipment

– Take up or lay fitted carpet or floor coverings.

– Dismantle or assemble any items for eg. unit systems, furniture, fitments or fittings etc.

– Move storage heaters, unless they are dismantled.

– Move items from a loft or a cellar, unless properly lit and safe access is provided.

– Should the customer pay any money to the contractors on the day of the move for work carried out which does not form part of the move specification as per the booking confirmation, unless the additional work has been authorised by the supplier, or management of the contractors – prior to completion of said work, then this money is not deemed in favour of the supplier or removal contractor, and the work carried out will be charged via separate invoice.

Restricted items not to be moved

We are not a common carrier and therefore cannot accept dangerous goods (i.e. gas cylinders, volatile liquids, fuel containers to be emptied, etc.).
The following items are not permitted to be removed unless previously agreed and an inventory is submitted in writing to the Bestin Moving and/or the Removals Contractor:
– Jewellery, watches, precious stones or metals, money, deeds, securities, stamps, coins or goods or collections, prohibited or stolen items, drugs, dangerous, damaging or explosive items, including gas bottles, firearms, and ammunition.

– Plants or goods which may cause vermin or other pest infestation.

– Any animals and their cages, or tanks including birds or fish.

If you have any goods you are unsure of then please request permission to be moved by the Contractor prior to the move date.

Cancellation

Should any Contractor be unable to carry out a removal due to any unforeseen circumstances, within 24 hours of the agreed pick up time/date we will notify you (the) customer as soon as practically possible and arrange a refund of the deposit paid.
Should the customer cancel the removal, the cancellation fee will be equal to the deposits paid.

Delays

All effort is made to ensure deliveries/collections are made on time/date. However, neither party shall be liable to the other for any loss or damage (direct or consequential) occasioned to the other from any cause beyond the control of the Contractor, as the case may be, including delay in transit (unless resulting from want of due care and skill or breach of this contract by the other), industrial disputes, acts of God, weather difficulties or acts of third parties. The contractor gives an undertaking to the customer to contact them as soon as possible/practicable regarding any delay that may be experienced.

Confirmation of satisfactory completion and delivery of services

The customer or customer’s authorised person/agent, must pay the remaining balance immediately as acceptance of satisfactory delivery at/or prior to the unloading of goods. The contractor will not deliver any part of the removal without the final payment as confirmation of acceptance of goods received in good order. Therefore if the customer is unable to make immediate payment at the time of delivery, whether the removal is paid in full or not, the goods will not be offloaded and may be returned to the contractors depot, stored at a local storage facility or third party depot at the cost of the customer, inclusive of additional offload/uplift fees, as applicable.

Sub-Contract

Should the removals contractor be unable to meet a deadline for any reason they retain the right to sub-contract the removal or part thereof to a third party in order to fulfill the contract to the customer, at no additional charge.

Other Insurance

The contractors undertaken to carry out the removals and/or storage with professionalism, duty of care and skill.

– Transit cover applies to goods in transit and covers your goods against damages or loss resulting from fire, theft or rollover of the conveying vehicle. The company shall not be liable to the Client for any loss or damage whatsoever suffered by the Client, either directly or indirectly, including but not limited to economic loss, loss of profits, liabilities to third parties, caused by: any damage, loss or destruction of goods in the provision of services, a misdelivery, delay in delivery or non-delivery of the goods; theft, overturning, fire, collision, road or rail accident not involving the conveying vehicle; or the carriage of the goods by a route other than the shortest or usual route.

Personal information

The ‘Client’/’customer’/’company’ authorises ‘NAME YOUR PRICE FOR Products and Services Pty Ltd’ trading as ‘BESTIN MOVING’, ‘BEST PRICE Interstate Removals And Backloading Services Australia’ and/or ‘James’, Hemi Wilson’ or ‘James (Hemi) Wilson’ to use any or all details provided for any Services as part of our database. Client understands that personal details will be kept confidential but non personal information like first name and any comments received by the client verbally over the phone or via text or email maybe used in a testimonial or promotion without written consent

Insurance

All customers must obtain their own insurance against damage or loss of their goods and by agreeing with these Terms & Conditions the customer knows and understands NO insurance is included.

Quotation and Deposits

Unless otherwise stated in the quotation:

An initial deposit is due and payable upon acceptance of the quotation to enable booking date to be confirmed.
The Customer shall be deemed to have accepted the Quotation by paying the Confirmation Deposit within the period/date/time specified in the quote
Payment of the Confirmation Deposit for the Products and Services shall be deemed to be acceptance of the Quotation pursuant to these Terms and Conditions.
The customer will be notified if the meterage/inventory of items or access differs from the quotation after uplifting possibly resulting in extra charges. Payment for additional charges may not be possible at that time but must be made at/before delivery.
Unload and reload fees may be applicable due to delays or any changes made by the customer (i.e. different delivery address or delayed delivery).
Final/remaining payment(s)/balance of removal, inclusive any additional fees, must be paid prior to unloading the goods. Driver is instructed to stay in his truck until payment is received. Any delay or time will be charged.
The quoted price may change or additional charges may apply if any of the following have not been taken into account when preparing the quotation:
– If at the time of the move it is found that the move is different to the information you have supplied in the Quotation request, the Removals Contractors may charge an additional amount to cover the cost of additional items, time and labour.

– If you self-certify the size of your move by completing an inventory checklist or estimating the cubic metres and on the day of the move it is found that items have been omitted/added from the agreed details of the quote then additional charges may be applied at the discretion of the removals company.

– If the Removals Contractor has to supply any additional services, previously not included in the quotation, such as disconnecting appliances, dismantling furniture, or storing additional items not previously included in the quotation.

– Should access to the property be not as described, and will not allow free movement of the goods without the need of alterations or hire of additional equipment, or the access to the property be not suitable for the Removal Vehicle to get within 20 metres of the doorway, and as a result the removal Contractors have to do additional work not included in the Quotation.

– Any charges incurred for parking, toll roads, congestion fees, or any other charges levied by the government for transportation of goods from the current property to the new property.

Ownership of goods

The customer must be the legal owner of the goods being transported.
By entering the contract you declare that:
– The goods to be removed and/or stored are your own property, or

– The person(s) who own or have an interest in them, have given you permission to make this Contract, and have been made aware of the Contract.

– You will meet any claim for damages, and any costs against Bestin Moving and/or the Removals Contractor, if these declarations are not true.

Price and Payment

The price for the Products and Services is as specified in the Quotation, and may or may not be inclusive of GST and other applicable charges as outlined in the Quotation.
Payment of the price shall be in the manner specified in the Proposal.
We accept payment by bank transfer/deposit, cash, credit card and EFTPOS(if available) unless stated otherwise in Quote.
We do not accept cheques, money orders & sometimes certain or all credit cards.
Should the final balance not be received at the allocated time of delivery and/or the driver be unable to wait for the payment due to delays on the part of the customer, the goods will be returned to the contractors depot, stored at a local storage facility or third party depot at the cost of the customer, inclusive of additional offload/uplift fees, as applicable.
You may not withhold any part of the payment, failure to finalise the balance before the move date will result in the move being postponed, cancelled, or revoked until the balance has been paid unless specified otherwise.
Any cancellation fees incurred will be met by you.
Should payment not be received by the due date then the move may be postponed, cancelled, or revoked.

Additional Charges

In order for the company or contractor to provide a quote which is fair, the quote is based on the information given by the customer at the time of booking. The following points should be considered as they may be charged as additional items if not declared correctly at the time of booking:
Difficult Access. The customer will be asked at the time of booking if the access to the upload & set down locations are deemed standard (standard access is defined as a ground level building to which a legally registered heavy vehicle (max. height 4.3 metres) collecting or delivering a consignment can, Safely and legally approach, park and depart, without disruption, overhead obstructions or cost; and once parked, be within a walking distance of no more than 20 metres from the vehicles loading or unloading point to the allocated entry of the building, via a max. of five (5) steps, and be of regular, safe and stable surface; and over the distance, the rise or fall shall not exceed 1.5 metres with a gradient of not more than one in five (1in5) ; and the point of collection or placement within the building shall not exceed twenty-five (25) metres from the allocated building entry point. Should the customer’s pickup or delivery points be outside this definition (and they have not notified the contractor prior to the pickup/delivery date), the contractor reserves the right to adjust the quote and request further payment due to the difficulty of the access. The extra charge is payable at the point/s at which it is incurred. The driver and truck must wait at the applicable address until the additional payment is made.
Waiting time is charged at $160 per hour.
Understated load. Should the load quantity be more than that quoted, the contractors driver will notify the customer at the time of upload and additional charges will be due and payable before unloading
Furniture will be delivered in a disassembled state. If assembly/disassembly is required this must be requested at the time of booking and additional charges will apply. All items must be ready for transportation. Fragile goods must be packed and marked as such to avoid damage
Heavy, unusual or Bulky Items. Any items that are too heavy or large for 2 men to safely upload (more than 120kgs approximately) must be declared at the time of booking. The contractor may not be able to upload these items if not declared. There may be additional charges if the contractor is able to upload and they were not declared at the time of booking.

Non payment

The Company reserves the right to exercise a lien over the goods until such time as full payment is received for the services provided. In the event the Client fails or refuses to provide full payment at the time of unloading, the Company may refuse to unload, hold, seize or retain any goods as security for payment. In the event the invoice provided by the Company remains unpaid for after the lien has been exercised, the Company may give not less than 10 days written notice by email or post to the last known address of the Client of the Company’s intention to sell the goods. In the event the payment is not received at the expiry of the 10 days written notice of the intention to sell the goods, the Company may dispose of the goods or sell any or all of the goods by any means at its discretion without being liable in any respect to the Client.
